New Jersey's new governor, Mikie Sherrill, is taking on a controversial issue head-on: the role of ICE (Immigration and Customs Enforcement) in her state. This bold move has sparked a legal and political clash with the Trump administration, setting the tone for Sherrill's governorship and offering a glimpse into the Democratic Party's immigration strategy for the upcoming midterm elections.
The recent killings of two U.S. citizens by federal agents in Minneapolis have shifted public opinion, with polls showing a growing disapproval of ICE's tactics. This provides an opportunity for Democrats like Sherrill to gain political ground by taking a stand against the agency. Sherrill, a former House member, ran on a platform of challenging the Trump administration, and she has certainly lived up to that promise.
'A Battle for the Soul of New Jersey'
Sherrill's administration has sued the federal government over critical funding for infrastructure projects and even the administration's vaccine schedule. Like other Democratic governors, she is using her state's power to counter the Trump administration's policies, especially with her party out of power in Washington, D.C.
However, Sherrill finds herself in a delicate position. Republicans argue for closer collaboration between state and federal law enforcement, while some Democrats want her to push the legal boundaries even further. Her colleagues see her as a bulwark against President Trump's aggressive immigration agenda, but she must navigate these differing expectations.
"Many of my constituents believe the only help they can get is at the state level," said Rep. LaMonica McIver (D-N.J.). "People expect our new governor to take action."
New Jersey, with its high percentage of immigrant residents, is at the forefront of this debate. Republicans are pushing for local police to work more closely with ICE, while progressive Democrats propose a 50% tax on private immigration detention facilities, with proceeds going to pro-immigration causes.
'A Line in the Sand'
Sherrill, a moderate Democrat, must decide how far she will go in her anti-ICE stance. She has taken a more confrontational approach than her predecessor, Phil Murphy, who implemented sanctuary policies but also tried to collaborate with the president in other areas. Sherrill has compared ICE to East Germany's secret police and called it Trump's 'militia,' and she is backing up these words with actions.
She recently signed an executive order limiting ICE activity on state properties and creating an online portal for residents to report immigration officials. The DOJ is challenging this order, arguing it will 'obstruct and endanger law enforcement.'
But Sherrill's most significant move is her support for making New Jersey's 'sanctuary' policy permanent. This policy, known as the Immigrant Trust Directive, limits cooperation between state and local law enforcement and federal immigration authorities. Unless it becomes law, it could be undone by a future governor.
'A Shift in Perspective'
Sherrill's position on codifying the directive has evolved. During her election campaign, she gave vague answers and even suggested she might allow federal agents more leeway in certain situations. However, the killings in Minnesota changed her perspective, leading her to recognize that the fear extends beyond those with undocumented status to American citizens as well.
"We're seeing small businesses suffer as people are afraid to go to work, and children are being kept home from school," Sherrill said. "The fear is real, and it's affecting everyone."
'Standing Up to the Bully'
Rev. Dr. Charles Boyer, a politically influential pastor who endorsed Sherrill, believes that places of worship should have state resources to respond to federal immigration agents. He envisions a quick response system where state law enforcement would protect worshippers from ICE.
"I think it's important to stand up to the bully," Boyer said. "The Trump administration may try to make examples of us, but we cannot back down."
Sherrill's administration is now tasked with developing a blueprint for responding to ICE agents across the state. A state law requires the Attorney General to establish 'model policies' by July for institutions like hospitals, schools, and places of worship. This will undoubtedly be a challenging and controversial process, but Sherrill and her team are committed to protecting the rights and well-being of all New Jersey residents.
'A Test of Leadership'
As Sherrill navigates these complex issues, she faces pressure from all sides. Some groups, like the ACLU of New Jersey, want to eliminate exemptions in the directive, while others propose unmasking ICE agents, a move that legal experts say could face legal challenges.
Regardless of external pressures, Sherrill's administration must find a balance between protecting the rights of immigrants and navigating the legal boundaries of state-federal relations. It's a delicate dance, but one that Sherrill and her team are prepared to lead.
"We have to confront the bully," Sherrill said. "It won't be easy, but it's the right thing to do."
